As a result of this, several different constitutional challenges have been filed against the enforcement of federal gambling laws. Many of the challenges involve issues relating to the Commerce Clause and the Due Process Clause. However, these attacks have been relatively unsuccessful.
Other constitutional challenges involve the notion that the First Amendment guarantees free speech and that the government’s authority to enforce gambling laws violates the Constitution. However, the question remains whether the Commerce Clause gives the government legislative power to prohibit gambling. A commercial activity like gambling seems to satisfy the Commerce Clause concerns, but questions remain about whether it gives the government the power to regulate gambling in a way that protects the free speech of its citizens.
Some state officials have expressed concern that Internet gaming could bring illegal gambling into their jurisdictions. The US Attorney General’s Office has warned PayPal and others that it could be charged with violating the Illegal Gambling Business Act if they continue to accept financial instruments from illegal Internet bets.
Although the Commerce Clause may protect the free speech of American citizens, the government’s authority to prohibit gambling may not extend to the home. However, state laws do regulate gambling activities in the home. Some state laws also prohibit certain forms of sexual conduct in the home. Moreover, the law preventing gambling in the home does not protect the right to privacy.
The US Department of Justice recently determined that real-money casino games on the Internet were legal. In addition, a company called K23 Group Financial Services was charged with violations of the Unlawful Internet Gambling Enforcement Act. The company agreed to pay a $4.2 million fine and launch a $3 million public service campaign.
